I just received a call from a woman in tears because a collection agency was threatening to have her thrown in jail for non-payment of a credit card debt.  I told her to rest easy.

First of all, we don’t have Debtor’s Prison in this country for the non-payment of a debt. Secondly, it is a violation of both the Texas and Federal Fair Debt Collection Practices Acts to threaten someone with jail to attempt to collect on a debt.

Our country is in a recession and a lot of folks are out of work. When people get behind on their bills, collection agencies will start to call.  Know your rights.  You may owe the debt, but that does not mean they can throw you in jail for it. If a collection agency makes a threat like that, tell them to “put it in writing”.
